Erik Estavillo continues to make a mockery of the U.S. judicial system

Ringling Banner 2

Erik Estavillo is the gift that keeps giving.  He seems to be a perpetual source of entertainment, at least for me. Despite coming across as a money-hungry weasel, and a “professional plaintiff,” as Joystiq law expert Mark Methenitis puts it, he continues to use the American court system as his personal financial playground.

This guy is out of control.

Since losing and appealing his PSN case against Sony Computer Entertainment America, Estavillo has sued Nintendo of America, Microsoft and Activision Blizzard, even going so far as to subpoena actress Winona Ryder and Depeche Mode member Martin Lee Gore in his suit against the World of Warcraft owner. His claims are ridiculously flimsy in my eyes, and need to be seen to be believed.

He actually contests that Nintendo shouldn’t be able to block the Homebrew Channel, which allows Wii owners to play unauthorized games.  The restitution he seeks from Microsoft is utterly galling.  The Xbox 360 maker certainly deserves criticism for the widespread failure issues associated with its console, but that doesn’t give Estavillo the right to demand $75,000 in return.  It’s pretty obvious that he’s in it for the cash; almost like he’s playing the damn lottery or something.

That’s not all though.  In yet another strange twist, Estavillo has summoned former Microsoft executive Bill Gates to court, demanding that he bring a substantial amount of hardware-related data to the proceeding.

This entire saga has devolved into a three-ring circus, with Estavillo acting as a ringleader who rides a unicycle, juggles fire, drives a clown car, and pulls cotton candy out of his arse, all at the same time.  If I wore the robe, and one of these cases landed on my docket, I would throw it out immediately.  Frivolous cases such as these only mock the U.S. judicial system, and serve no purpose whatsoever.  As amusing as this entire charade has been, it’s time for young Erik to return to his hole.

The depressing truth is, such frivoluious lawsuits have succeeded in the past. Take the classic example of the McDonald’s coffee woman. She gained a nice amount of monetary gain for spilling hot coffee in her lap.

At this point in time, I would contest that (as far as lawsuits are concerned), the judicial system is already a mockery in some cases.

I’d be interested to hear Lono’s take on this.

he’s a laywer so actually i think he would be insulted to hear you mock the justice system that’s like saying “THE ROYAL MAIL SUCK! Now what do you think random postal worker?”

when will eric give this up? He’s never going to win in fact i think he’s a mockery for disabled people.

Sad thing is, we’ve gone past the whole “laugh at him” thing now, and into the “sad” territory. All is not right with this man and I reckon he probably needs help.
